Picketing

Public employee strikes are legal under conditions established by Oregon statutes. However, certain limitations may be imposed on picketing activities to ensure the public health and welfare.

It is ordered by the Board that:

  1. Picketing activities are limited to public sidewalks and those specifically identified zones established by the district;
  2. Clearly marked safety zones will be identified in which picketing activities are prohibited;
  3. Picketers are prohibited from entering district facilities for any reason whatsoever;
  4. Playground and school yard areas are off limits to picketers;
  5. Picketers will not block or otherwise occupy any driveway or parking lot area adjacent to any school site;
  6. The district will instruct legal counsel to initiate complaint proceedings against any picketer who violates provisions of this policy.

All striking employees shall confine picketing, parading or labor dispute activity to the public streets or non-school district property.

All picketing or parading employees shall refrain from blocking or obstructing vehicle or pedestrian access to district property or students, parents, school buses, district vehicles, other employees, service and repair concerns, police, fire protection or other authorized vehicles.

Violation of the foregoing regulation and order may be cause for disciplinary proceedings.

The superintendent and all licensed administrative employees of the district are hereby designated as the person or position holder in charge of all district premises within the meaning of Oregon Revised Statutes.

Any person entering upon district property for purposes of picketing, parading or other concerted labor dispute activities may be charged with criminal trespassing.

It shall be an unfair labor practice for a public employee, a labor organization or its agent to picket; cause, induce or encourage picketing; or threaten to engage in such activity at the resident or business premises of any individual who is a member of the governing body of a public employer with respect to a dispute over

a collective bargaining agreement; negotiations over employment relations if the objective or effect of the picketing:

  • $ Induces another to cease doing business with the governing body member’s business; or
  • $ Ceases handling, transporting or dealing in goods or services produced by the governing body’s business.
